Wachovia Mortgage Group v. Eide:The County demurred to the Second Amended Cross-Complaint, which the court sustained. The County
has been dismissed from the suit.
Walls v. Higgins:Unconstitutional initiative petition limiting compensation of Board members withdrawn after County Counsel filed lawsuit.
Hudack v. Siggard:Attorney fee motion against County for $336,469 struck down.
County v. Nescher: Abatement of a substandard dwelling and payment of over $64,000 in costs and attorney fees awarded to County.
Pacheco v. Board:Lawsuit to compel Board to fund additional District Attorney positions dismissed.
County v. Audie Murphy Ranch:Negotiated settlement with surety (ICW) for payment $6.3 million to complete Newport Road and Goetz Bridge (Dist. 3).
County v. Audie Murphy Ranch:Negotiated settlement with surety (Travelers) to complete Murrieta Road (Dist. 3) at Traveler’s expense.
County v. Audie Murphy Ranch: Obtained $25,640 in delinquent taxes from Travelers.
County v. Desert Gold:Negotiated a settlement with Travelers to complete Varner Road and 24 inch waterline under Frank Sinatra and I-10 crossing (4th Dist.).
County v. BC Christensen Ranch:Negotiated settlement with International Fidelity Insurance for completion of street improvements along Antelope Road and Craig Road intersection (3rd Dist.) and installation of traffic signal
County v. Santiago: Steve Avenue in Mira Loma extended from 58th to 60th Street (2nd Dist.)
People v. Indiana Lumberman’s Mutual Ins. Co.: Important case for counties upholding the forfeiture of bail bonds with costs and attorney fees awarded to the County.
Rural Communities United v. County:Trial Court and Court of Appeal ruled in favor of County and confirmed manner in which County enforces its surface mine conditions of approval are discretionary and cannot be compelled by writ of mandate.
County v. R & L Bouchard:Resolved waste processing/service of equipment business ordinance violations and recovered costs of enforcement.
County v. Winchester Square:Murrieta Hot Springs Road (3rd Dist.) street work completed.
County v. Tract 29170 LLC: Spring Street and Murphy Avenue (Dist. 5) street work completed.
County v. Western Pacific Housing:Bellgrave Avenue (2nd Dist.) street work completed.
Valenzuela v. Gutierrez: Damages action involving two children hit by automobile while crossing Route 79 dismissed after County Counsel filed a demurrer to complaint.
Roach v. County:County Counsel quashed summons and complaint for damages in connection with a code enforcement matter.
Hazard Construction v. COR: $980,748 claim settled for $596,000 with no attorney fees.
Shadowcliff Homeowners Association v. County:Lawsuit against County to set aside tax sale and quiet title dismissed
Aguilar v. County: Limonite Underpass Beautification Project completed with final disbursements on project.
Craneveyor v. Greg Harris Construction:Corona storm drain project completed and settlement funds paid by surety.
Vanderwal v. County: Court ruled in favor of County and denied writ to order County to record final subdivision map.
People v. Cleaves:Motion to deem animals abandoned and for costs of $55,544 granted.
Cleves v. County:Court dismissed complaint against County.
Whiting v. Gelinas: Court denied petition for restraining order against Sheriff.
CREST project (new property tax system) development and negotiation of $30 million project
In response to potential parole of felon Donald Smith, County Counsel prepared two urgency ordinances:1) prohibiting Parolee-Probationer Homes (Ord. Nos. 449.239, .449.240 & 449.241) and 2) establishing sex offender residency and loitering prohibitions (Ord. Nos. 901 & 902).
Other important ordinances adopted:Ord. No. 578.5-Historical Preservation Districts; Ord. Nos. 449.242 & 449.243-urgency ordinances related to hillside development; Ord. No. 787.6-adopting 2010 Fire Code
Proposed County Charter drafted.
Counter measure to RSA Pension Initiative drafted and adopted.
